Welcome to New Era Roofing Construction (“we”, “us”, “our”). These Terms and Conditions govern your use of our roofing and construction services (the “Services”). By contracting or engaging with New Era Roofing Construction, you agree to be bound by these Terms and Conditions.
Please read these terms carefully before engaging in our Services.
- Services
New Era Roofing Construction provides roofing, maintenance, repair, and construction services. The scope of the Services will be agreed upon in the project proposal and contract, which will outline the work to be performed, the materials to be used, and the timeline for completion.
- Estimates and Proposals
2.1 Non-binding Estimates: Initial estimates are non-binding and subject to change based on the scope of work or unforeseen circumstances discovered during the project.
2.2 Final Proposal: Once the scope of the work is agreed upon, we will provide a final proposal detailing the cost, materials, and timeline. By accepting the proposal, you agree to the terms of this agreement.
- Payment Terms
3.1 Deposit: A deposit of [X%] of the total project cost is required before the commencement of work. This deposit is non-refundable unless otherwise agreed in writing.
3.2 Payment Schedule: Payments are to be made according to the schedule outlined in the final proposal or contract.
3.3 Late Payments: Failure to make payments on time may result in work suspension, late fees, and/or legal action.
3.4 Final Payment: The final payment is due upon the completion of the project, subject to any outstanding issues being resolved to mutual satisfaction.
- Changes to Scope of Work
Any changes to the scope of work requested after the final proposal is agreed upon will require a written change order. This may result in changes to the project timeline, cost, and materials.
- Materials and Warranty
5.1 Materials: All materials used will be as specified in the contract. Any changes to materials must be approved in writing and may incur additional costs.
5.2 Warranty on Workmanship: We provide a warranty on our workmanship. Any defects or issues arising from poor workmanship during the warranty period will be corrected at no additional cost.
5.3 Manufacturer’s Warranty: Any warranties for materials are provided by the manufacturer. New Era Roofing Construction is not responsible for defects in materials provided by third-party manufacturers but will facilitate any claims on behalf of the customer.
- Permits and Compliance
We will obtain the necessary permits required for the completion of the Services unless otherwise agreed. We are committed to complying with all local, state, and federal laws related to construction and roofing.
- Client Responsibilities
7.1 Access: You agree to provide access to the property and any utilities necessary for the completion of the work.
7.2 Obligations: You are responsible for ensuring the site is prepared and ready for work as agreed upon in the contract.
7.3 Insurance: You are responsible for maintaining appropriate homeowner’s or property insurance during the project.
- Delays and Force Majeure
New Era Roofing Construction is not liable for delays caused by weather, unforeseen site conditions, delays in material supply, or other events beyond our control, including but not limited to natural disasters, strikes, pandemics, or government actions (force majeure). In such cases, we will make reasonable efforts to complete the project as soon as possible.
- Liability
9.1 Damage: New Era Roofing Construction is not responsible for any damage to personal property unless due to our negligence or intentional misconduct.
9.2 Third-party Liability: We are not liable for any issues or damages caused by third-party contractors unless subcontracted by New Era Roofing Construction.
9.3 Limitations: Except as expressly provided, New Era Roofing Construction will not be liable for any consequential, indirect, incidental, or punitive damages.
- Termination
Either party may terminate this agreement in writing if the other party breaches any material provision of the contract. In case of termination, the client will be responsible for payment for work completed up to the termination date.
- Dispute Resolution
In the event of any disputes arising out of this agreement, both parties agree to first attempt resolution through good-faith negotiations. If the dispute cannot be resolved, the parties may pursue mediation or arbitration as a means of resolution.
- Governing Law
These Terms and Conditions are governed by and construed by the laws without regard to conflict of law principles.
- Amendments
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website or notifying you in writing.
- Severability
If any provision of these Terms and Conditions is held to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire Agreement
These Terms and Conditions, along with any contract or proposal, constitute the entire agreement between the parties and supersede any prior agreements or understandings.
